Biologic Input Output Systems, Inc (BIOS) Consumer Health Data Privacy Policy

This Consumer Health Data Privacy Policy supplements Biologic Input Output Systems, Inc., (BIOS) Privacy Policy. To the extent of a conflict between the terms in our general Privacy Policy and the terms in this Consumer Health Data Privacy Policy, the terms in this Consumer Health Data Privacy Policy shall control.
Biologic Input Output Systems, Inc., (BIOS) develops a universal neural interface that enables bi-directional neuromuscular coordination with sensory feedback between the brain and advanced devices. In the course of conducting research, product development, and participant engagement, we may collect and process certain health-related data. This Consumer Health Data Privacy Policy describes the Consumer Health Data (as defined below) that BIOS collects, uses, discloses, and processes in accordance with applicable U.S. state consumer health data privacy laws, and explains the rights that may be exercised by individuals pursuant to such laws.
As used herein, “Consumer Health Data” means information that is linked or linkable to an identified or identifiable individual who is a resident of a U.S. state with an applicable consumer health data privacy law and that identifies the individual’s past, present, or future physical or mental health status (each such individual, a “Consumer”).
Categories of Consumer Health Data Collected
BIOS collects the following categories of Consumer Health Data:
- Data about individual health conditions, treatment, diseases, or diagnoses
- Data about use of medical technologies or neurotechnological devices
- Data about health-related surgeries, procedures, or interventions
- Data about medications used or prescribed
- Data about physical abilities, functional status, or neurofunctional capabilities
- Data related to biometric, neurological, or physiological measurements
- Information collected during research participation or clinical evaluation
- Information derived or extrapolated from other sources that is used to identify a Consumer’s health status
BIOS does not permit third-party tracking of Consumer Health Data across different websites or services.
Sources and Manner of Collection
BIOS collects Consumer Health Data directly from Consumers, including research participants, through the following channels:
- Secure online forms hosted on BIOS-operated or BIOS-contracted websites
- Consent-based enrollment in research programs
- Data shared through communication with BIOS researchers or customer support
- Sensors, wearables, or interfaces used during clinical evaluations or trials
All Consumer Health Data is transmitted through secure, encrypted channels and stored using industry-standard security protocols.
Categories of Consumer Health Data Shared
BIOS may share each of the above categories of Consumer Health Data with the following third parties, only as necessary for research or operations and as permitted by law.

- Research institutions and academic partners collaborating on joint studies
- Contracted clinical sites conducting studies or assessments
- Cloud hosting providers that securely store and manage BIOS research systems

BIOS does not sell Consumer Health Data.
Purposes for Processing Consumer Health Data
BIOS collects, uses, and shares Consumer Health Data for the following purposes:
- To conduct, support, and improve research studies involving human participants
- To determine eligibility for participation in clinical or product testing studies
- To communicate with study participants and respond to participant questions
- To improve BIOS neurotechnology devices and user experience
- To evaluate the safety, usability, or effectiveness of BIOS systems
- To compile non-identifiable aggregate data for research publications or innovation efforts
- To comply with legal, ethical, or regulatory obligations
Consumer Rights
Under U.S. state consumer health data privacy laws, you may have the following rights:
- Request confirmation of whether BIOS is collecting, sharing, or using your Consumer Health Data
- Request deletion of your Consumer Health Data
- Request a list of third parties with whom BIOS has shared your Consumer Health Data
- Withdraw consent for the collection or sharing of your Consumer Health Data
- Request that BIOS stop collecting or sharing your Consumer Health Data

If BIOS denies your request in whole or in part, you have the right to appeal. To appeal, email info@bios.works with the subject “Appeal Request” and a description of why you believe your request should be approved. BIOS will respond to appeals within 45 days and, if your appeal is denied, provide information on how to contact the relevant state attorney general to file a complaint.
Updates to this Policy
We may update this Consumer Health Data Privacy Policy to reflect legal requirements or changes in our practices. Please review it periodically. The effective date will be updated at the top of this document when changes occur.
